He was the second Commanding Officer of teh 99th Foot; he was born in 1788 and his early military service was in the 40th Foot. 99th Regiment - A black and white photo of officers of the Regiment in China 1860-61 with (Left to Right) Quartermaster John Johnston, Captain Charles Burton, Paymaster Frank Potter, Lieutenant Colonel Henry James Day (Commanding Officer), -?-, Ensign John Francis Stephens. After returning to Hong Kong, the Light Company was sent to Shanghai under Captain Burton, where it fought the Taiping rebels in the assault on the rebel camp at Tserpoo on 17 April 1862. This photograph appears on page 27 of The Wiltshire Regiment 1756-1914
